What Are the Penalties for Drug Trafficking in Tennessee?

A drug trafficking charge is life-altering, risking your future and freedom. In Tennessee, “trafficking” can simply mean “Possession with Intent to sell or deliver” based on the amount possessed. Understanding Tennessee Drug Laws

In Tennessee, drug offenses fall under Tennessee Code Annotated (T.C.A.) § 39-17-417. This statute makes it a crime to knowingly manufacture, deliver, sell, or possess a controlled substance with the intent to manufacture, deliver, or sell.

The severity of the penalty depends on two main factors:

  1. The “Schedule” (classification) of the drug.
  2. The quantity of the drug involved.

Tennessee classifies drugs into Schedules I through VII. Schedule I drugs (like heroin) are considered the most dangerous with no accepted medical use, while Schedule VI covers marijuana.

Penalties for Schedule I and II Drugs (Cocaine, Meth, Fentanyl)

The state punishes offenses involving Schedule I and II drugs most severely, including substances like cocaine, methamphetamine, fentanyl, and heroin.

Cocaine and Methamphetamine

For cocaine and methamphetamine, the weight of the substance determines the felony class:

  • Less than 0.5 grams: Class C felony (3 to 15 years in prison; fines up to $100,000).
  • 0.5 grams or more: Class B felony (8 to 30 years in prison; fines up to $100,000).
  • 300 grams or more: Class A felony (15 to 60 years in prison; fines up to $500,000).

Fentanyl

Fentanyl is a significant focus for Tennessee lawmakers. The penalties reflect this urgency:

  • Less than 0.5 grams: Class C felony (3 to 15 years).
  • 0.5 grams or more: Class B felony (8 to 30 years, fines up to $100,000).
  • 15 grams or more: Class B felony, with the fine increasing to $200,000.
  • 150 grams or more: Class A felony (15 to 60 years) with fines up to $500,000.

Marijuana Trafficking 

While some states have relaxed their marijuana laws, Tennessee remains strict. Marijuana is a Schedule VI controlled substance. The penalties for selling or possessing marijuana with the intent to sell are based heavily on weight:

  • 1/2 ounce to 10 pounds: A Class E felony. This carries a sentence of 1 to 6 years in prison and fines of up to $5,000.
  • 10 pounds to 70 pounds: A Class D felony. You face 2 to 12 years in prison and fines up to $50,000.
  • 70 pounds to 300 pounds: A Class B felony. The sentence ranges from 8 to 30 years, with fines of up to $200,000.
  • 300 pounds or more: A Class A felony. This carries a sentence of 15 to 60 years in prison and fines of up to $500,000.

Sentencing Enhancements

Certain factors, sought by prosecutors in Davidson and Hamilton Counties, can increase drug trafficking penalties. 

Drug-Free School Zones

Tennessee law (T.C.A. § 39-17-432) enhances penalties for offenses within 500 feet of a school, park, library, or childcare center. While the zone was recently reduced from 1,000 feet and judges now have more discretion, this charge remains serious. Prosecutors may seek stricter sentencing if children were present. 

Weapon Possession

Possessing a firearm during a dangerous felony, such as drug trafficking, adds a mandatory consecutive sentence, meaning the gun sentence begins after the drug sentence is complete.

The Court Process in Nashville and Chattanooga

If you are arrested in Nashville, your case will likely proceed through the Davidson County Criminal Court. In Chattanooga, it will go through the Hamilton County Criminal Court.

These courts are busy. Prosecutors often push for plea deals that look convenient but carry long-term consequences. You need a legal team that is familiar with the local judges, the specific prosecutors, and the procedures in these courthouses.
