Essential guide for mixed-status families in the U.S.

Can they deport U.S. citizens? ๐Ÿšจย ย 

If you are a U.S. Citizen, donโ€™t worry, you can’t be deported. Whether you were born in the U.S. or naturalized, you have rights that protect you. BUT… there have been cases where ICE has detained citizens by mistake, causing them unnecessary panic. The good thing? Being wrongly detained doesn’t mean they can remove you from the country.ย 

Can they take away the citizenship of someone naturalized? ๐Ÿค”ย 

Only in rare cases and if fraud is discovered in the naturalization process. It’s not something that happens out of the blue or that you should worry about if everything was done correctly.ย 

What about parents of US citizens? ๐Ÿ‘จโ€๐Ÿ‘ฉโ€๐Ÿ‘งโ€๐Ÿ‘ฆย โ€โ™€๏ธ

Here’s the tricky part. If the parents are undocumented, their status does NOT change just because their child was born here. That means that, even if the child is a citizen, the parents could still be deported. And with changing immigration policies, many families live with the uncertainty of what will happen in the future.ย 

What the 14th Amendment Says ๐Ÿ“œย 

The U.S. Constitution is crystal clear: if you were born in the country, you’re a citizen, regardless of your parentsstatus. It’s as simple as that.ย 

Can they deport a U.S. born citizen? ๐Ÿšซย 

Nope! There is no legal way to do it. Although there have been wrongful detentions due to ICE mistakes, if you’re a citizen, they can’t remove you from the country. Does something like this happen to you? Come for legal help right away!ย 

Options to regularize your status and avoid deportation:

  1. If your family is of mixed status (i.e., some have documents and some don’t), you should know that there are legal options to stabilize your status. That sounds great, right?!ย ย 

    1. โœจ Family Petition (I-130) The crown jewel! If you have a citizen or permanent resident relative, he or she can petition for you. Sure, it’s not automagic (hopefully), but it’s a great first step.ย 
    2. ๐ŸŒŸ Parole in Place (PIP) for military families If your spouse, dad or son is in the U.S. military, you could qualify for this special permit. A lifesaver for many!ย 
    3. ๐Ÿ’ช Cancellation of Removal If you’ve been in the country for more than 10 years, have good moral character, and your departure would affect a citizen family member, you could fight to stay. Wow! Can you imagine?
    4. ๐ŸŽ‰ U Visa and T Visa A light in the darkness! If you have been a victim of crime or human trafficking, these visas can protect you and open doors to residency. ๐ŸŒฟ
    5. โš–๏ธ Asylum and Temporary Protected Status (TPS) If your life is in danger in your country for political, social or religious reasons, you may be able to apply for these protections. ๐ŸŒŸ
