VAWA: All you need to know! 💪✨

today we’re going to talk about a very important topic of hope: the VAWA. If you’re feeling a little lost or overwhelmed by the situation, don’t worry! I’m here to help you understand it in a simple and clear way. So get ready for an informative journey! 🚀 

What is the VAWA? 🤔 

The Violence Against Women Act (VAWA) not only protects women; it also provides opportunities for men who have been victims of abuse. Yes, that’s right! 💖 So, if you’ve ever felt trapped in an abusive relationship and think you might be eligible for a self-petition, this blog is for you. 

Who can file a VAWA? 🏠 

In order for you to file a VAWA petition, there are a few requirements you must meet. Let’s break it down! 📝 

  1. Qualifying Relationship: you must have a relationship with a U.S. citizen or lawful permanent resident. This can be as:
  • Spouse, future spouse, or former spouse (if the relationship ended for abuse-related reasons). 
  • Child of an abusive parent. 
  • Parent of a U.S. citizen child who is 21 years of age or older. 
  1. Victimization: You need to show that you were a victim of abuse or extreme cruelty by your U.S. citizen or permanent resident relative. This is very important! 🤕

3.Residency: You must have lived or be living with the abuser. This helps establish the context of the situation. 

4.Good moral character: Although it sounds a bit formal, it is essential that you can demonstrate that you are a person of good moral character. No wrongdoing here! 😇 

What if you are not currently married? 🤷♀️

Don’t worry, you can file the petition even if you are no longer with your abusive spouse. Just make sure that your marriage ended within 2 years prior to your filing and that there was a connection to the abuse. that sounds fair, right?!  

What if I’m outside the US? 🌍 

Good question!!! If you live outside the country, you may still be eligible if you meet certain requirements. For example, if your abusive family member is a member of the U.S. military or if you suffered abuse in the U.S. So don’t lose hope!  

Derivative beneficiaries 👶 

If you have children under 21 and unmarried, you can include them in your self-petition! This means you’re not only taking care of yourself, but also your family. that’s love! 💖

  1. Can a man file a petition by himself?
  2. Yes! VAWA protects everyone, regardless of gender. 🙌
  3. Do I have to stay married to my abusive spouse during the process?
  4. No! You can file the petition if you are no longer with them, as long as you meet certain requirements.👍
  5. What if my abusive spouse filed a petition on my behalf?
  6. Good news! The priority date can be transferred to your form I-360. That can speed up your process! 🚀
